HOLYOKE BALL CLUB LLC PARTICIPANT WAIVER AND RELEASE OF LIABILITY

In consideration of being allowed to participate in any way in the Holyoke Ball Club LLC athletics/sports program, including team or individual sports, related events, and activities, I, the undersigned, acknowledge, appreciate, and agree that:

Assumption of Risk – The risk of injury from participation is significant, including but not limited to sprains, fractures, concussions, permanent paralysis, or death. While rules, equipment, and personal discipline may reduce risks, the potential for serious injury still exists. I knowingly and voluntarily assume all such risks, whether known or unknown, including those arising from the negligence of the Releasees.

Compliance with Rules – I agree to follow all stated and customary rules for participation. If I observe any hazard or unsafe condition, I will remove myself from participation and report it to an official immediately.

Release of Liability – I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, release and hold harmless Holyoke Ball Club LLC, its officers, directors, officials, agents, employees, volunteers, other participants, sponsors, advertisers, and, if applicable, owners or lessors of the premises used for events (collectively, "Releasees"), from any and all claims of injury, disability, death, or damage to person or property, whether caused by negligence of the Releasees or otherwise. This release does not extend to gross negligence or intentional misconduct.

Medical Authorization – I authorize Holyoke Ball Club LLC to provide or obtain emergency medical treatment on my behalf if needed and accept responsibility for any related costs.

Photo & Media Release – I understand that photos or videos may be taken during events. Holyoke Ball Club LLC has my permission to use these for promotional purposes on social media, websites, or other materials. I may request removal of specific images in writing within a reasonable timeframe.

Severability & Governing Law – If any provision of this waiver is found unenforceable, the remaining provisions shall remain in full effect. This agreement is governed by the laws of Massachusetts.

I HAVE READ AND UNDERSTAND THIS AGREEMENT, FULLY ACKNOWLEDGE ITS TERMS, AND SIGN IT VOLUNTARILY. I UNDERSTAND THAT I AM WAIVING SUBSTANTIAL RIGHTS BY SIGNING.
